Terms and Conditions
These terms and conditions and the purchase contract are concluded in the Slovak language. Effective from: 1 March 2022.
I. Basic provisions
These general terms and conditions (hereinafter the "terms and conditions") are issued by the seller:
Profi Trading s.r.o.Švábovce 65, 059 12 Švábovce
mobil: +421 903 679 421, e-mail: ProfiTradingSro@gmail.com
Zapísaný v Obchodnom registri Okresného súdu Prešov, oddiel: Sro, vložka č. 45833/P
Orgán dozoru: Inšpektorát SOI pre Prešovský kraj, Obrancov mieru 6, 080 01 Prešov 1, pr@soi.sk, tel. č. 051/772 15 97
The terms and conditions govern the mutual rights and obligations of the seller and the buyer who enters into a purchase contract through the web interface at www.bufiky.sk (hereinafter the "online store"). The provisions of the terms and conditions form an integral part of the purchase contract; a differing arrangement in the purchase contract takes precedence over them.
II. Information about goods and prices
Information about the goods, including price and main characteristics, is provided for each item in the online store's catalogue. Prices include all related charges and remain valid for as long as they are displayed in the online store. The presentation of goods is informative and the seller is not obliged to conclude a purchase contract. Information about packaging and delivery costs applies only to deliveries within the Slovak Republic. Discounts on the purchase price cannot be combined with each other unless agreed otherwise.
III. Order and conclusion of the purchase contract
The buyer places an order through their customer account or by filling in the order form without registration. When placing an order, the buyer selects the goods, quantity, and method of payment and delivery; before submitting, they may review and change the details. The order is valid only if all mandatory fields are filled in and the buyer confirms having read these terms and conditions.
Immediately after receiving the order, the seller sends the buyer an automatic confirmation to the e-mail address provided; this confirmation is considered conclusion of the contract, and the current terms and conditions are attached to it. If the seller cannot fulfil a requirement, they will send an amended offer, which is considered a new proposal for a purchase contract. All accepted orders are binding. The buyer may cancel the order until they receive notice of its acceptance.
In the event of an obvious technical error in the price of the goods, the seller is not obliged to deliver the goods at this obviously incorrect price, even if an automatic order confirmation was sent.
IV. Payment terms and delivery of goods
- cash on delivery, paid to the courier upon receipt of the goods,
- by bank transfer in advance, against a proforma invoice (the goods ship once the payment arrives),
- in cash upon personal pickup at the premises.
For payment by bank transfer the purchase price is due in advance against a proforma invoice; for the other payment methods the seller does not require any advance deposit. In accordance with the act on sales records, the seller issues the buyer a receipt (invoice). The goods are delivered to the address specified by the buyer in the order, or collected in person at the seller's premises; the delivery method is chosen during ordering. Delivery costs are stated in the order and its confirmation. The buyer is obliged to accept the goods on delivery and check the packaging is undamaged. Title to the goods passes to the buyer upon payment of the full purchase price including delivery costs, but not before the goods are taken over.
V. Withdrawal from the contract
A buyer who is a consumer has the right to withdraw from the purchase contract without giving a reason within 14 days of receiving the goods (or the last delivery). To meet the deadline, it is enough to send a withdrawal statement before it expires; the buyer may use the sample form provided by the seller.
The buyer must return the goods within 14 days of withdrawal and bears the costs of returning them. The seller will refund the buyer all payments, including delivery costs (at the amount of the cheapest delivery method offered), no later than 14 days after withdrawal, using the same means of payment, but not before the buyer hands over the goods or proves they have been sent. The goods must be returned undamaged, unworn, and if possible in their original packaging.
The consumer may not withdraw from the contract in the cases listed in Section 7(6) of Act No. 102/2014 Coll., in particular for goods customised to the consumer's wishes, perishable goods, or digital content supplied other than on a tangible medium with the buyer's consent. The seller is entitled to withdraw from the contract due to stock clearance or unavailability of the goods; in that case they will promptly inform the buyer and refund any payments received within 14 days.
VI. Rights from defective performance
The seller is liable to the buyer for the goods being free of defects on receipt and having the properties agreed by the parties or that the buyer could reasonably expect given the nature of the goods. The buyer is entitled to claim rights for a defect that occurs in consumer goods within 24 months of receipt. If a defect occurs, the buyer may request:
- for a remediable defect – free repair or replacement of the goods with new ones;
- for an irremediable defect – a reasonable discount on the purchase price or withdrawal from the contract.
The seller will determine how to handle the claim immediately, within 3 working days in complex cases, or within 30 days in justified cases. Handling a claim may not take longer than 30 days from the date it is made; a failure to meet this deadline is considered a material breach of contract. Further details are set out in the seller's complaints policy.
VII. Delivery of correspondence
The parties may deliver all written correspondence by e-mail – the buyer to the seller's e-mail address stated in these terms, the seller to the buyer's e-mail address stated in the order.
VIII. Alternative dispute resolution
A consumer has the right to approach the seller with a request for redress if unsatisfied with how a claim was handled. If the seller responds negatively or does not respond within 30 days, the consumer has the right to file a proposal to initiate alternative dispute resolution. The competent body is the Slovak Trade Inspection Authority (registered office Obrancov mieru 6, 080 01 Prešov 1), which can be contacted for this purpose at the address Slovenská obchodná inšpekcia, Ústredný inšpektorát, Odbor medzinárodných vzťahov a alternatívneho riešenia sporov, Obrancov mieru 6, 080 01 Prešov 1, or electronically at ars@soi.sk or adr@soi.sk; www.soi.sk. The online dispute resolution platform can also be used at ec.europa.eu/consumers/odr. Alternative dispute resolution applies only to contracts concluded at a distance and does not apply to disputes where the value does not exceed EUR 20. The European Consumer Centre Slovak Republic, Mlynské nivy 44/a, 827 15 Bratislava, esc-sr.sk, is also a point of contact.
IX. Final provisions
All arrangements between the seller and the buyer are governed by the law of the Slovak Republic. All rights to the seller's website, in particular copyright to the content including page layout, photographs, graphics, trademarks and logo, belong to the seller; it is prohibited to copy, modify or otherwise use the website or any part of it without their consent. The seller may amend or supplement the wording of the terms and conditions; this does not affect rights and obligations arising during the validity of the previous wording. A sample withdrawal form is attached to these terms and conditions.
